Terms of Service

Please read these Terms of Service ("Terms") carefully before using XReport Pro ("Service"), operated by XReport ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

XReport Pro is a cloud-based platform that enables healthcare professionals and organisations to build structured medical forms, collect report data, manage workspaces, and collaborate with team members. The Service is provided on a software-as-a-service basis.

2. Eligibility and Accounts

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Service. By using the Service, you represent that you meet these requirements.

2.2 Account Registration

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@xreport.pro if you suspect unauthorised access.

2.3 Workspace Access

You may be invited to join workspaces by other users. Workspace owners are responsible for managing member access and ensuring their team's compliance with these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Violate any applicable laws or regulations, including healthcare privacy laws
• Upload or transmit content that is unlawful, harmful, or infringing
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to send unsolicited communications
• Interfere with the integrity or performance of the Service
• Use the Service to process data for which you do not have lawful authority

4. Your Content and Data

4.1 Ownership

You retain all ownership rights to the forms, reports, and other content ("Your Content") you create through the Service. By using the Service, you grant us a limited licence to store, process, and transmit Your Content solely to provide the Service to you.

4.2 Responsibility

You are solely responsible for Your Content and for ensuring that you have all necessary rights, consents, and permissions to upload and process it — including any patient or clinical data. We are not responsible for the accuracy, completeness, or legality of Your Content.

4.3 Healthcare Data

The Service may be used to create forms that collect clinical or patient-related information. You, as the data controller, are solely responsible for compliance with applicable healthcare data protection regulations (including GDPR, HIPAA, or local equivalents). We provide technical safeguards but do not assume responsibility for regulatory compliance on your behalf.

5. Intellectual Property

The Service, including its design, software, branding, and all associated intellectual property, is owned by XReport and protected by applicable laws. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.

6. Payment and Subscriptions

Certain features of the Service may require a paid subscription. Subscription terms, pricing, and billing cycles are described at the point of purchase. All fees are non-refundable except where required by law. We reserve the right to modify pricing with reasonable notice.

7. Availability and Modifications

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to communicate significant changes.

8. Termination

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases and we may delete Your Content in accordance with our data retention policy (see our Privacy Policy).

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

XReport Pro is a tool for form building and data collection. It does not constitute medical advice, clinical decision support, or a certified medical device. Clinical judgement remains with the qualified healthcare professional.

10. Limitation of Liability

To the fullest extent permitted by applicable law, XReport shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of business, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and Hungary, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Hungary.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
